Shiur on Mitzvas from Rambam's Mishneh Torah - Part 1

Introduction: The Structure of Mishneh Torah

What we're going to learn now is to begin a bit with the mitzvos that the Rambam wrote in brief at the beginning of Mishneh Torah. Because it works on this seder, right? And one needs to know all the mitzvos - even if one doesn't go according to the Seder HaMitzvos, one needs to know what all the mitzvos are.

The Rambam says that the Gemara is basically a peirush and an expansion on the mitzvos of Torah SheBichsav, because it's Torah SheBaal Peh - it's the peirushei hamitzvah. And in Sefer HaMitzvos, which the Rambam wrote before Mishneh Torah, he first made a long hakdamah clarifying how we know what the taryag mitzvos are. He brings the lashon Chazal that there are taryag mitzvos, and based on those kelalim he wrote the Sefer HaMitzvos. Here he makes a kitzur, a summary of all the mitzvos.

The entire Sefer Mishneh Torah - all the halachos in Mishneh Torah have some mitzvah, a heading of a mitzvah. Every halachah in Mishneh Torah begins with what is the mitzvah in the Torah that has to do with that inyan - the halachos and the mitzvos. And now he's going to count out all the mitzvos.

The Nature of Sefer HaMitzvos

It's worthwhile to remember that the Sefer HaMitzvos is not really "the Sefer HaMitzvos" - it's really the sefer of "heichi timtza eilu hein hamitzvos." It's more of a lamdanishe sefer, it's not made to...

The Lubavitcher Rebbe made three sedarim: one where you learn three perakim, one perek, and then he said that whoever can't learn that either should learn Sefer HaMitzvos - so he made a seder of Sefer HaMitzvos. The Count of Mitzvos

Minyan mitzvos shel Torah hanohagin l'doros - "l'doros" he doesn't mean to say after the churban, he means to say permanent mitzvos. Most of the mitzvos are indeed a part, but not something that was once in the midbar, you know, "lo yarbeh ha'am" - one shouldn't take more than the manna. Not things that go into the Torah. The Order of the Mitzvos

Mitzvos Aseh: The First Group - Knowing Hashem

U'l'hispallel lo - the Rambam holds that tefillah is a mitzvah d'Oraisa. Shene'emar "va'avadtem es Hashem Elokeichem" - v'eizo hi avodah shebalev? Zu tefillah. This is the Gemara, yes.

L'davkah bo - the Rambam explains what this is. Shene'emar "u'vo sidbak." I don't know what exactly, but I know that in Hilchos De'os it should be... Ah, no, l'damos b'drachav. Okay. There's another mitzvah - there's l'davkah bo and there's l'damos b'drachav. L'davkah bo means to hang with talmidei chachamim.

Nine: L'kadeish shemo - one should be mekadesh His name. The Rambam is going to say mitzvas kiddush Hashem - that one should be moser nefesh for Him. Shene'emar "v'nikdashti b'soch Bnei Yisrael."

Mitzvos of Torah Learning and Its Accessories

L'kro Krias Shema pa'amayim b'chol yom - shene'emar "v'dibarta bam b'shivtecha b'veisecha u'v'lechtecha vaderech u'v'shachbecha u'v'kumecha" - these are the two times: b'shachbecha u'v'kumecha.

Mitzvos of the Beis HaMikdash

L'hani'ach lechem u'levonah lifnei Hashem b'chol Shabbos - every Shabbos one should prepare the lechem hapanim with the levonah. Shene'emar "v'nasata al hashulchan lechem panim."

L'haktir ketores pa'amayim b'yom - shene'emar "v'hiktir alav Aharon ketores samim."

La'aroch eish al mizbach ha'olah tamid - one should prepare a fire on the mizbach ha'olah. Shene'emar "eish tamid tukad al hamizbe'ach."

L'harim es hadeshen mei'al hamizbe'ach b'chol yom - one should separate the deshen from the mizbe'ach every day. Shene'emar "v'heirim es hadeshen."

L'shale'ach temei'im mimachaneh Shechinah - this whole group of things is being mechabed the Beis HaMikdash. מצוה ס', די זעכציגסטע מצוה: להיות כל הקרבנות מבהמה מיום השמיני והלאה - מ'זאל נישט נעמען קיין בהמה אונטער די אכט טעג, און נעמען אים יום השמיני והלאה. דער "נישט" איז אפשר א לאו, איך ווייס נישט, אבער דאס איז א מצוות עשה על כל פנים.

להיות כל קרבן בהמה תמים - אז מ'טאר נישט ברענגען א בהמה בעל מום. ס'איז נישט קיין לשון לאו, אבער ס'איז א לשון אז יעדע בהמה זאל זיין תמים. שטייט דאך "תמים יהיה לרצון."

למלוח כל קרבן - יעדע קרבן זאל מען ברענגען מיט זאלץ. שטייט דאך "על כל קרבנך תקריב מלח."

סוגי הקרבנות

מעשה החטאת - די מצוה פון וויאזוי מ'איז מקריב א חטאת. שטייט דאך "זאת תורת החטאת."

מעשה האשם - ווען א מענטש האט א ספק, אנדערש ווי א חטאת. אשם איז בעיקר אויף א ספק. שטייט דאך "זאת תורת האשם."

מעשה זבח השלמים - שטייט דאך "וזאת תורת זבח השלמים."

מעשה המנחה - שטייט דאך "ונפש כי תקריב קרבן מנחה."

קרבנות מיוחדים

להקריב היחיד קרבן חטאת על שוגג במצוות לא תעשה שחייבין עליה כרת - שטייט דאך "ונפש כי תחטא בשגגה." מ'האט דאך שוין געזאגט פריער מעשה החטאת - דאס איז די מצוה איז איין מצוה, און דא איז דא א מצוה אז מ'זאל עס טון, מ'זאל ברענגען א קרבן.

להקריב היחיד קרבן אשם - אויב מ'איז מסופק אין חטא שגגה שחייבין עליו חטאת, דארף מען ברענגען אן אשם תלוי.

דאס איז נאך אן אשם. נאר איין סארט, איין אופן איז שוגג במעילה, אדער חטא בגזילה, אדער שבועת העדות, אדער שבועת הפקדון. אויב איינער האט מועל געווען בהקדש - ער האט הנאה געהאט פון הקדש - אדער חטא בגזילה, אדער שבועת העדות, אדער שבועת הפקדון - און ער האט זיך געשוואוירן אז ער האט געלייקנט אז ער דארף יענעם באצאלן פקדונות, און ער האט געשוואוירן פאלש. פאר די אלע זאכן דארף מען ברענגען א קרבן אשם, וואס דאס הייסט אן "אשם ודאי."
