it does make some sense to have punishments in a separate chapter, but is that the pshat?

if the reasoning for punishment is למען ישמעו וייראו it doesnt really matter if the specific person actually did it

thats why really standard of proof in civil cases should be higher than in criminal

cause civil law is about making justice

criminal is just about legalized killing

i mean organized revenge

why? if you stole money from me there is real justice done to have you return it

if you killed my brother theres no justice in killing you

i was thinking if the punishments here are addresed to the beis din?

it doesnt say who its talking to

and lumps together heavenly punshments with real ones- i

אולי הבהמה באמת אשמה ובהמה צדיקה לא היתה מסכימה, מה אנחנו מבינים על בהמות..

או לאידך גיסא, בני אדם אנחנו בטח לא מבינים כל כך בלב להגיד שהוא אשם.. זה המעשה שאנחנו יכולים לראות..

כן שכחתי, פרק כ

גם הגוי אסור לו לתת לזרעו למולך, כלומר הגר.. זה לא איסורים מיוחדים לישראל. צריכים לסדר משהו על פי הפשט איזה דברים נאמר בכם שזה גם הגר ואיזה מיוחדים לאזרח או ישראל, יש משהו על זה?

כתוב פעמיים שמקבל כרת לא ברור. אולי זה ככה. מי שנותן למולך מקבל סקילה בידי אדם,וגם השם מצדו מכרית אותו. לא כתוב מה פירוש כרת.

ואם לא יקבל סקילה כי יעלימו עיניהם, אז השם יכרית לא רק אותו אלא גם משפחתו. אולי כי הם אשמים שהעלימו עין.

זה בהנחה שכרת הרגיל הוא לא קשור למשפתתו

אז אני לא משוגע… אבל החילוק שלו בין בהמה זכר לבהמה נקבה עוד יותר מוזר אע״פ שהדיוק שלו בפסוק נכון
